Overview:

The California Consumer Privacy Act (CCPA), which took effect on January 1, 2020, is the newest statute intended to improve the data use transparency and privacy rights within the state. One of its significant prohibitions is the selling and disclosure of California residents’ personal information, particularly of children under 16 years old. Businesses and individuals who fail to comply with and violate these prohibitions are further confronted with increased liability under the Children’s Online Privacy Protection Act (COPPA), a federal law that restricts the collection and use of personal information of children under the age of 13.

With the changing regulatory landscape and more stringent privacy regulations, the future of the CCPA and COPPA is still uncertain. Thus, businesses must keep themselves updated with emerging developments and critical issues. They must also proactively revisit their practices to avoid non-compliance and legal liabilities.

Kathryn (Kit) Garcin specializes in data privacy, information security, intellectual property and technology transactions. Kit regularly works with clients to design and implement data privacy, information security, and risk management programs. She provides creative and practical advice on meeting the requirements of  privacy laws, including the California Consumer Privacy Act , Children’s Online Privacy Protection Act , and  Fair Credit Reporting Act. She crafts guidelines and compliance programs for clients’ collection, use, and disclosure of personal information in diverse contexts and for  clients including, investment funds, national residential and commercial property management companies, and market research firms. Her work includes drafting privacy and cookies policies and online service terms of use, as well as assessing and managing privacy risks.

Max Brunner, Senior Counsel

Max Brunner is a senior counsel in the Corporate & Finance department in the Allen Matkins  San Francisco office. His corporate practice is focused on mergers and acquisitions, public and private securities offerings, corporate governance, commercial contracts and other complex corporate matters and transactions. Max has advised on mergers and acquisitions matters totaling over $40 billion and securities offerings totaling over $13 billion. Max is a member of the PropTech practice group that counsels companies in the real estate technology ecosystem.

 

Max also advises clients on state, federal and international privacy laws and cybersecurity matters from both a compliance and a risk management standpoint. He provides practical advice on achieving business objectives while complying with applicable privacy laws.
