Overview:

The usage and the import of asbestos are facing greater scrutiny today as pressures from several US states continue to emerge along with the call for a tighter regulation on public health risks. While the Environmental Protection Agency (EPA) has issued a final rule prohibiting most asbestos-containing products, some uses are still legal, including asbestos diaphragms, sheet gaskets, and other vehicle friction commodities. Moreover, in a report released by the United States Geological Survey (USGS), around 750 metric tons of raw asbestos was imported in 2018. This is the largest amount imported since 2013 despite the amendments made in the Toxic Substances Control Act (TSCA) as well as other federal laws allowing only a “limited use” of asbestos.

Timothy L. Krippner represents dozens of manufacturers in product liability and toxic tort matters throughout the United States. His current responsibilities include retention as trial, local, regional and national coordinating counsel. Mr. Krippner also has considerable experience defending general product liability, professional liability, medical malpractice and construction matters. At Segal McCambridge Singer & Mahoney, Mr. Krippner served on the firm’s Executive, Marketing and Budget Committees during a period of growth from one local office, to offices in Chicago, Austin, Detroit, Jersey City, New York, Philadelphia, and St. Louis.

Andrew M. Voss, Officer

Andy Voss represents clients in the defense of lawsuits in federal and state courts involving asbestos, toxic torts, product liability, construction, premises liability and general commercial litigation.  He had his first asbestos deposition in 1998 and has continued to represent asbestos defendants for over twenty years. He has extensive experience in some of the country’s most challenging venues, including the City of St. Louis, Missouri, and Madison County and St. Clair County, Illinois.  He also has experience handling matters in the MDL 875, U.S. District Court, Eastern District of Pennsylvania.

Andy handles all aspects of litigation from the time a case is filed until its resolution, including substantive motion practice, discovery issues, taking and defending expert depositions, and ultimately, trial.  In the field of asbestos, he has successfully argued complex motions, in particular motions to dismiss based upon lack of personal jurisdiction and motions to dismiss based on forum non conveniens.  He has taken hundreds of depositions, including depositions of plaintiffs, plaintiffs’ fact witnesses, treating physicians and expert witnesses, served as national coordinating counsel and has been lead counsel on thousands of asbestos cases.
