Overview:

The unceasingly evolving field of cannabis continues to bring complex regulatory challenges among businesses and legal practitioners. Although still illegal under federal law, several states and territories in the US have already legalized the use of cannabis for both medical and recreational purposes. In April 2022, the U.S. House of Representatives passed the Marijuana Opportunity Reinvestment and Expungement (MORE) Act. If passed by the Senate, the MORE Act would abolish criminal penalties for federal cannabis offenses, decriminalize cannabis at the federal level, and expunge past federal cannabis convictions.

She is the leader of the firm’s Cannabis Industry Team and serves on the firm’s Pro Bono, Recruiting and Diversity & Inclusion committees, as well as numerous industry specific teams.  Whitney’s practice focuses on the representation of clients involved in real estate development and environmental compliance. Specific to cannabis operators and ancillary service providers, Whitney advises and represents through all phases of the regulatory process, including due diligence investigations, negotiating and drafting transactions agreements, processing land use entitlements, advising on environmental and natural resources law, and appearing before governmental agencies and commissions.

  • Cannabis law remains at crossroads between federal criminalization and state legalization. Without some sort of federal regulatory oversight, this has led to legalization occurring on a state-by-state basis, creating a patchwork of potentially conflicting regulatory schemes.
  • As more states “come online” as it relates to legal cannabis operation, operational problems continue to mount. Forget comprehensively addressing the dichotomy between federal and state approaches, the federal government – in all three branches – has failed to even provide even an incremental panacea to ongoing issues. Instead, new issues, including potential violations of the U.S. Constitution, continue to plague the industry.
  • From taxes to banking, from company formation to permitting requirements, cannabis operators in today’s market need to be cognizant of the various pitfalls presently occupying the space.
