Overview:
The patent law landscape evolves at an accelerating pace, making it a challenge for patent law experts to navigate the Patent Trial and Appeal Board (PTAB) minefield every year. Some of the most anticipated developments this year include:Â final rules on allocation of burdens, motions to amend, all claims and challenges, and elimination of the presumption favoring petitioners; activity on discretion to institute; issuance of the indefiniteness guidance memorandum; key cases from the Federal Circuit and Supreme Court; and the pending Arthrex case.

Brian Murphy, Partner
Haug Partners
Brian Murphy is a partner at Haug Partners in New York City. Prior to joining Haug Partners, Brian presided over nearly 200 America Invents Act (AIA) post grant review proceedings as a Lead Administrative Patent Judge at the PTAB.
Brian acts as counsel or as a consultant to clients and counsel involved in PTAB post-grant trial proceedings, district court patent litigation and trials (jury and non-jury), and Federal Circuit appeals. He has represented clients in the pharmaceutical, biotechnology, medical device, consumer products, telecommunications, and electronics industries. He has particular expertise in Hatch-Waxman patent litigation. He also provides strategic advice and opinions, conducts mock oral arguments, acts as an expert witness, conducts IP due diligence, and mediates intellectual property disputes.
Eugene T. Perez, Partner
Birch, Stewart, Kolasch & Birch, LLP
Eugene Perez has practiced in the intellectual property field since 2000, specializing in chemical, pharmaceutical, and biotechnology patents. His experience includes prosecuting patent applications, including corresponding with clients and preparing replies to all USPTO correspondence such as Office Actions and Restriction Requirements, initiating and conducting inter partes reviews (IPR), reissue applications, ex parte and inter partes reexamination proceedings, conducting legal research and preparing freedom-to-operate, patentability, infringement and invalidity opinion letters. Mr. Perez has also argued before the Court of Appeals for the Federal Circuit, as well as before the USPTO Patent Trial and Appeal Board.
Mr. Perez received his B.A. in Molecular and Cell Biology from the University of California, Berkeley, he received his Master’s in Biochemistry from George Washington University and went on to earn his J.D. from George Mason University.
Mr. Perez serves as the editor for BSKB’s Post Grant Proceedings website, a site devoted to post-grant patent review procedures, including IPRs, post-grant reviews, ex parte reexaminations, and reissue applications.

Over the course of her nearly twenty-year career, Erin M. Dunston’s practice has been a purposeful mix of patent prosecution and litigation. With a background in biochemistry, she concentrates her practice primarily in the fields of biotechnology, pharmaceuticals, medical devices, and associated computer technology. To date, Erin has handled more than 20 district court litigations and more than 25 inter partes reviews (IPRs) before the Patent Trial and Appeal Board (P.T.A.B). Assisting both patent owners and putative infringers/petitioners, this experience ranges from pre-filing analyses all the way through appeals to the U.S. Court of Appeals for the Federal Circuit.
