  • The FTC’s Final Rule on Noncompete Agreements was meant to ban almost all non-compete agreements, both existing agreements and future agreements.
  • There are some limited exceptions to the Final Rule.
  • Lawsuits have been filed challenging the FTC’s authority to issue the Final Rule, which ultimately may invalidate the applicability of the Final Rule.
  • Even though the Final Rule has now been stayed, all employers should think about alternative ways to protect their trade secrets, confidential information, and customer goodwill.
