Inter Partes (IPR) and Post Grant Reviews (PGR) have become an essential part of the patent litigation battlefield.  With Patent Office priorities and Federal Circuit decisions such as Arthrex, Inc. v. Smith & Nephew, Inc. constantly changing the landscape for these proceedings, it is imperative for all patent litigants to be well-versed with recent Federal Circuit decisions as well as recent decisions that the Patent Office has designated Precedential or Informative.

Nate Louwagie practices intellectual property law with an emphasis on patent litigation and counseling at Carlson Caspers. He represents U.S. and foreign clients from a broad range of industries, including pharmaceuticals, medical devices and chemicals. Nate is a member of teams providing counsel on ANDA disputes, international and cross-border patent disputes and other matters.

Nate is a registered patent agent with the U.S. Patent and Trademark Office.

Peter regularly represents clients in inter partes review proceedings (IPRs) before the Patent Trial and Appeal Board (PTAB).  He has worked on matters involving a variety of technologies, including nutraceuticals, automotive technology, and medical devices.  Peter has extensive experience in every step of the IPR process, from crafting IPR petitions and patent owner responses to arguing motions and final Oral Hearings.

Peter has developed a particular expertise in IPR procedure, helping clients to navigate the complexities of parallel district court and IPR proceedings.  Peter also has participated in many IPR appeals, including recently helping a client convince the Federal Circuit to reverse and remand an IPR decision involving mechanical technology.

Russ’s career has focused on litigation, strategy and counseling of patent and trade-secret matters.  In his role as in-house counsel at Intellectual Ventures, Russ manages the defense of the company’s intellectual rights across forums, including IPR, CBM, PGR, re-exams at the USPTO, and in opposition practice before the European Patent Office and other foreign jurisdictions. He is engaged daily in overall patent strategy and use of IV’s vast portfolio through strategic prosecution and licensing.  Russ is a specialist in all aspects of post grant proceedings and has been involved with many dozens of matters before the Patent Trial and Appeal Board and their Federal Circuit appeals.

Before joining Intellectual Ventures, Russ was a partner at Carlson Caspers representing a diverse set of clients, from Fortune 500 companies to small start-ups. In private practice, he litigated a wide spectrum of technology disputes, from pre-suit investigation through trial and appeal to the Federal Circuit.
