Overview:

U.S. International Trade Commission (ITC) investigations have been on the rise over the past years. Just in the first quarter of 2020, a significant increase in the number of lawsuits and ancillary cases have been launched, as well as inquiries underway. The ITC also continues its efforts and investigations under Section 337 despite the extended postponement of its in-person hearings because of the current COVID-19 pandemic.

Given the increasing number of complaints and risks of exclusion orders, companies should be aware of the methods used to avoid or terminate investigations under Section 337. They must also be cautious of the new developments especially with the prevalence of COVID-19.

Cyrus Frelinghuysen is Of Counsel in Greenberg Traurig’s Washington, D.C. office. He focuses his practice on intellectual property and trade matters.  Cyrus has litigated disputes in district courts and before the U.S. International Trade Commission (ITC), having handled numerous investigations under Section 337 of the Tariff Act of 1930.  Cyrus also advises clients on compliance and enforcement matters, including U.S. Customs and Border Protection (CPB), the Office of Foreign Assets Control (OFAC), and the Foreign Corrupt Practices Act (FCPA). He has represented clients across a variety of sectors and technologies, such as telecommunications equipment, mobile devices, semiconductors, and pharmaceuticals.

Robert Goldman is a Vice President in the Intellectual Property practice of Charles River Associates where for more than 20 years he has assisted clients in valuing intellectual property assets for a variety of business purposes, developing and implementing strategies for managing and realizing value from their IP portfolios, and assessing damages in IP litigation.  He has consulted in hundreds of matters involving the valuation of intellectual property including determination of damages, mergers and acquisitions, licensing and sale transactions, tax, and other purposes, with a focus on valuation of patent portfolios.  Mr. Goldman’s litigation experience includes the determination of reasonable royalty, lost profits and/or unjust enrichment in patent infringement, trade secret misappropriation, and copyright matters, analysis of the economic prong of the domestic industry requirement in Section 337 ITC investigations, commercial success analyses in PTAB IPRs, and the valuation of patent portfolios in bankruptcy matters.
