Hagai’s extensive experience includes: advising on civil and criminal investigations by the Israel Competition Authority, challenging monopoly declarations, merger control, collaborative joint ventures, distribution strategy, cartels, dominance, licensing, and class actions involving breaches of Israeli antitrust law. - Israel class actions regime in general – a well-established 30 years' experience in handling opt-out class actions, placed Israel as one of the most litigious and plaintiffs-friendly jurisdiction. We will present basic principles of Israel's class actions law to start with.
- Over the last ten years Israel had been pioneering antitrust class actions outside the US and Canada. We will review the place of private enforcement in Israel for antitrust matters, compared with the local regulator's enforcement priorities.
- Follow-on class actions for damages based on foreign infringement, enforcement and settlement/immunity proceedings are a real risk to any foreign company that has also businesses in Israel, and even for companies with only indirect activities or effects on Israel. We will review the main pending cases in this regard.
- After several years of dealing with procedural preliminary aspects (mainly, jurisdiction and service on foreign defendants) it seems that the Israeli Supreme Court is paving the way for private plaintiffs to submit and advance class actions in Israel against foreign defendants. We will review the main new decisions and determinations regarding jurisdiction, service, motions to dismiss and discovery of documents as part of the certification phase.
