Important developments and issues surrounding fair, reasonable, and non-discriminatory (FRAND) licensing and standard essential patents (SEPs) continue to persist and become burden to businesses and patent holders. Among the most notable updates the TCL v. Ericsson case’s remand from the Federal Circuit; and recent U.S. decisions (FTC v. Qualcomm and Continental v. Avanci) and the referral to the CJEU (Nokia v. Daimler) regarding refusal to license SEPs at the component level is an antitrust violation. Kyle Auteri is an Associate at Pearl Cohen’s New York office. His practice focuses on preparation and prosecution of U.S. patent applications in a variety of technologies and industries, with a particular focus on automotive and software applications. Kyle’s practice also includes defending clients in patent litigations involving software patents, and participating in FRAND licensing negotiations. After graduating from the University of San Francisco with a B.S. in Physics and Japanese Studies, Kyle attended New York Law School on a Dean’s Scholarship and graduated with Honors. While in law school, he focused his studies on Intellectual Property and received a Patent Law Certificate from New York Law School’s Institute for Information Law and Policy.

Désirée Heintz is a Patent Attorney, European Patent Attorney and European Trade Mark and Design Attorney at German based law firm Eisenführ Speiser since 2017. She studied Physics at the Westfälische Wilhelms-Universität Münster (diploma in 2008) and obtained her PhD (Dr. rer. nat.) at the Deutsches Elektronensynchrotron (DESY) in Hamburg in 2012. This was followed by legal training between 2013 to 2016 at Eisenführ Speiser, the German Patent and Trademark Office and the German Federal Patent Court.
Désirée Heintz has extensive experience in evaluating standard-essential patents (SEPs) and is a member of Eisenführ Speiser’s team for patent infringement cases involving SEPs as well as other fields of technology.
Shreya Gupta, Senior Consultant
Oxera Consulting LLP
Shreya Gupta is a Senior Consultant at Oxera’s London office. She leads the Oxera teams working on matters involving financial valuation and antitrust allegations in the context of commercial litigation and international arbitration. Shreya specialises in advising on economic issues related to FRAND royalties and abuse of dominance allegations in licensing disputes. She has acted as the named expert in such disputes and was shortlisted for inclusion in Who’s Who Legal: Arbitration 2020 – Future Leaders.
Shreya’s clients span a range of sectors, such as telecoms, pharmaceuticals, financial services and hi-tech, and include ASML, Conversant, Chugai, Ericsson, ICE Benchmark Administration (IBA), Intellectual Ventures, Lonza, PanOptis, Sisvel, Sportradar and Trustonic.
