Overview:

The pandemic-related lockdowns have posed great difficulties and challenges to businesses across industries and have incited a significant drop in demand for products and services. While some were able to cope with the situation through government assistance programs, others have sought bankruptcy protection to save their assets or restructure their balance sheets.

With the evolving legal landscape and onset of the “new normal,” organizations should stay abreast with all the developments and issues concerning corporate bankruptcy and restructuring. Mapping out strategies to employ a well-structured business plan in times of pandemics can be of great help.

In this LIVE Webcast, experienced business restructuring and reorganization lawyers Samuel R. Maizel (Dentons) and Victor A. Vilaplana (Practus, LLP) will provide the audience with a comprehensive discussion of the latest trends and developments surrounding corporate bankruptcy and restructuring. Speakers, among other things, will offer practical business strategies in these unprecedented times.

Key issues that will be covered in this course are:

  • Corporate Bankruptcy and Restructuring: Latest Updates
  • Demystifying the Impact of COVID-19 in Corporate Bankruptcy
  • Pandemic-Induced Chapter 11 Filing Trends
  • Exploring Effective Business Strategies
  • What Lies Ahead

  1. What are the “hot button issues” in corporate bankruptcy today? What recent decisions are likely to have a significant impact on cases in 2022-23? (Third party releases; the Texas two-step, “abuse of the process” in cases like NRA, decisions in Verity on sale of nonprofits and government provider agreements, etc.)
  2. The continuing impact of dealing with mass torts in bankruptcy. (Boy Scouts, Opioids, continuing church cases, etc.)
  3. What does the future portend for possible legislative changes? (venue? Warren/Cornyn bill, etc.)
  4. What has been the effect of the pandemic on bankruptcy and restructuring? (different effect on different sectors, effects of curtailed fed stimulus, higher interest rates, inflation, supply chain disruptions, accelerating electrification of cars, dramatic decrease in filings in 2021, maybe different towards end of 2022?)
  5. What are the three most likely areas to see a substantial increase in filings in 2022-23?
