Lauren Bachtel is counsel in Mayer Brown’s New York office and a member of the Projects & Infrastructure group. Prior to joining Mayer Brown, she was with another prominent firm and before that, Lauren was a US Department of the Interior (DOI) and American Wind Energy Association (AWEA) lawyer.

Lauren has represented energy industry coalitions and individual clients on various regulatory and administrative matters before the Bureau of Ocean Energy Management (BOEM), the Bureau of Land Management (BLM), the US Fish and Wildlife Service (FWS), the National Marine Fisheries Service (NMFS), and the Federal Energy Regulatory Commission (FERC). Lauren has deep experience in permitting matters for project development and financing purposes as well as drafting comments on administrative rulemakings, advising clients on policy and regulatory clarifications, negotiating proposed legislative bills, and federal litigation. She also has advocated on behalf of energy clients regarding climate and carbon policies. Lauren has extensive experience with permitting, compliance, and litigation under the National Environmental Policy Act, Mineral Leasing Act, Endangered Species Act, Migratory Bird Treaty Act, Bald and Golden Eagle Protection Act and Outer Continental Shelf Lands Act. She also has significant experience representing clients on Comprehensive Environmental Response, Compensation, and Liability Act and hazardous waste matters. As an attorney-advisor for DOI’s Office of the Solicitor, Lauren worked with BLM, FWS and the US Department of Justice (DOJ) on rulemakings, administrative actions and litigation that impacted the energy industries.

    • Historically, BOEM has generally conducted environmental reviews and consultations at two main points throughout the 4-Phase Process:  (1) Prior to holding competitive auctions; and (2) prior to approving project-specific Construction and Operation Plans
    • With the NY Bight, BOEM announced that it will be conducting a post lease issuance programmatic EIS.
  • BOEM is proposing new regulations for its offshore wind program
