Product liability and mass tort litigants historically have provided streamlined ways to organize and litigate matters involving hundreds of parties – a skill which has inured to parties’ benefit in proceeding with litigation events during the COVID 19 pandemic. As courts nationwide attempt to craft solutions for keeping justice open in these abnormal times, challenges have emerged with regard to deposition practice, remote hearings and even remote case resolution procedures. This program will discuss COVID 19’s immediate impact on litigation as well as newly emerging strategic considerations.

Jennifer Creedon is a trial attorney who represents large and small companies, product liability, business litigation, and asbestos litigation.  Jen also focuses on regulatory issues regarding consumer products and represents companies that manufacture, distribute and sell a wide range of products.

Jen represents manufacturers and retailers in litigation and compliance matters relating to product compliance issues.  Her regulatory practice involves a variety of state and federal product safety, chemical management and related regulatory issues and encompasses compliance, enforcement and litigation.  In particular, Jen routinely advises large and small companies regarding compliance with California Proposition 65.  Jen also regularly advises companies on market entry analysis and strategy including Safety Data Sheets, labeling and warnings, and litigation avoidance.

Jen has years of experience defending talc defendants as national, regional, and local counsel and is poised to defend any company involved in the newly emerging and new frontier of talc litigation.  Jen is cognizant of the high stakes nature of this possible “next asbestos” and is highly vigilant in representing her clients to protect their bottom lines.

Jen also defends construction defect cases regarding residential and commercial properties brought against contractors, manufacturers, suppliers and architects.  She is experienced in defending water intrusion, structural problems and toxic mold.

Whether a company’s litigation is confined to one lawsuit or requires a multi-lawsuit solution, Jen can craft a defense strategy that fits the company’s needs.  Jen has defended product liability and toxic tort actions in Massachusetts, Rhode Island and Connecticut. She has served as local, regional and national counsel for companies regarding toxic tort/asbestos litigation. Jen has been part of a national counsel team for a Fortune 500 company, drafted nationwide discovery, designed national trial strategy, including preparation of corporate/expert witnesses.  Jen is AV-Rated and has been selected annually as a New England Super Lawyer (2013-2018), and has been featured in The Best Lawyers in America.

Kate Wyatt is a trial attorney who handles companies’ products liability litigation, toxic tort litigation, construction defect litigation, premises litigation and business litigation in state and federal courts.  Kate prides herself on representing companies that range from the Fortune 100 to small family owned companies, and devising solutions for litigation avoidance.

For more than a decade, Kate has worked to defend products liability and premises liability actions as both local and national counsel in state and federal courts in a multitude of jurisdictions.  Kate’s practice has included the defense of complex toxic tort cases including talc matters, asbestos matters, and benzene matters.  In that capacity, she has worked to craft a nationwide defense, streamline the discovery process, and has prepared lay witnesses, corporate witnesses and expert witnesses, including medical experts, industrial hygienists, and intellectual property experts.

Kate also routinely defends cases brought against construction companies, contractors, building products manufacturers, suppliers, engineers, and architects involving both commercial and residential properties.  Her experience includes defending construction defect cases involving water intrusion, mold, drainage issues, roofing defects, and structural problems.  Kate has also defended fire and explosion cases.

Kate’s technical knowledge including intellectual property issues, science and medicine enables her to adeptly handle the most complex of cases and to provide clients with an excellent foundation to build creative and effective litigation solutions.  Kate has been named a “Rising Star” by New England Super Lawyers in the area of Civil Litigation each year from 2013-2018.

Kate Gardiner is an experienced litigation and trial attorney who focuses her practice in toxic tort and product liability litigation, with an emphasis in asbestos litigation. Kate has represented manufacturers, distributors, contractors and premises owners, including multiple Fortune 100 companies, in the power, military defense and construction industries. Kate has in-depth experience with defending cases in both state and federal courts, including multidistrict litigation. She won summary judgment motions in various federal courts that for the first time clarified both maritime and California law in favor of her clients.

For nearly two decades, Kate has advised clients in the development and implementation of defense strategies, including through the effective use of discovery, experts and dispositive motions. She proactively analyzes issues of potential liability in every matter to promptly determine and advise on the various risks and to create streamlined litigation and case resolution plans.

After participating in numerous trial academies, including the IADC Trial Academy, Kate created and continues to lead Walsworth’s own Trial College, which cultivates superior trial skills in associates through both hands-on practice and presentation by the firm’s experienced trial attorneys of proven best practices.
