Broadcast Date: Wednesday, August 09, 2023
from 12:00 pm to 1:00 pm (ET)

Overview:

Cryptocurrency markets experienced a series of setbacks and a number of high-profile bankruptcies in 2022. Regulators have ramped up enforcement efforts, in a professed effort to protect investors and address illicit activities. In the first half of 2023, the SEC brought a record number of crypto-related enforcement actions, including actions against crypto exchanges. The SEC also reopened rulemakings directed at platforms that bring together buyers and sellers of alleged securities, including digital assets. Amid these trends, crypto assets continued to raise novel legal questions and challenges for market participants in the ecosystem.

Join distinguished economic consultant Simona Mola (Cornerstone Research) and securities litigation and SEC enforcement defense partner Sarah Heaton Concannon (Quinn Emanuel Urquhart & Sullivan, LLP) as they provide an in-depth discussion of the current crypto ecosystem. Speakers will also provide the audience with the best practices to mitigate risks and explore other untapped potentials of the crypto business.

Key issues that will be covered in this course are:

  • Trends in SEC cryptocurrency enforcement activity and recent developments under the Gensler administration
  • Token issuers
    • SEC approach to initial coin offerings (“ICOs”) and regulatory debate
    • Recent enforcement cases
  • Crypto exchanges and intermediaries
    • Crypto platform enforcement and recent enforcement cases
    • SEC proposed amendments to the definition of “exchange” under Exchange Act 3b-16 and implications for crypto platforms, including DeFi systems
  • Other regulatory and enforcement developments
